Concerns Raised Over New Fatwa Committee in Southern Yemen

A senior official from the Presidential Office has expressed surprise regarding the recent decision by Aidroos Al-Zubaidi, a member of the Presidential Leadership Council and head of the Southern Transitional Council. Al-Zubaidi’s move to establish a preparatory committee for a Fatwa Authority, linked to the Ministry of Awqaf and Guidance, has drawn significant criticism. The official described this action as unilateral and inconsistent with the constitutional and legal frameworks governing the transitional phase, particularly the power transfer declaration.

Legal Violations Highlighted

The source from the legal affairs department emphasized that associating the Fatwa with the Ministry of Awqaf constitutes a constitutional and legal violation. The ministry’s powers are primarily executive and advisory, lacking the authority to create sovereign fatwa references. This decision threatens the unity of religious authority and risks fragmenting it, potentially igniting religious conflicts that could undermine societal peace.

Political Exploitation Risks

The official warned that such actions could lead to the exploitation of fatwas for political or partisan purposes. He reiterated that this decision falls within a series of previously annulled unilateral actions due to a lack of jurisdiction. Furthermore, it sets a dangerous precedent that undermines the constitutional and institutional framework of the state.

Call for Unity and Legitimacy

The source reaffirmed the rejection of all unilateral actions outside the constitutional and institutional framework. He stressed the importance of preserving community unity and upholding the state’s authority. The official urged against the establishment of parallel entities that could threaten sovereignty and constitutional legitimacy, thereby challenging the state’s exclusive powers.
